Terms and conditions
Purpose
keyhome24 is an online platform for publishing and viewing property listings (rent and sale) and property search requests in Switzerland. These terms apply to any use of the site, with or without an account. By creating an account or publishing, you accept them.
Applicable documents
The listing rules and the prices shown on the Pricing page form part of these terms. In case of conflict, a specific written agreement with keyhome24 prevails, then the listing rules, then these terms. A customer's own terms and conditions do not apply, even if the customer refers to them.
Role of keyhome24
keyhome24 connects people offering a property with people looking for one. keyhome24 is not an estate agent, landlord or seller, and is not a party to any contract between users. Each user checks the information and the person they deal with themselves.
Account
To publish, you create an account with accurate, up-to-date information. You must be at least 18 and legally able to enter contracts. You keep your password secret and are responsible for the use of your account. Property professionals register with an agency account and state their company; keyhome24 may ask for proof.
Listings
You alone are responsible for the content of your listings and requests. They must follow the listing rules and Swiss law. keyhome24 checks listings before they go online and may ask for a correction, refuse, pause or remove a listing at any time, without detailed justification, if it breaches these terms, the listing rules or the law.
Rights to content
The texts and photos you publish remain yours. You guarantee that you hold the necessary rights and do not infringe any third-party rights (copyright, trademark, image rights); keyhome24 may ask you for proof. You grant keyhome24, free of charge and for the duration of the listing, the right to store them, adapt them to the site's format (photo size and cropping), publish them on keyhome24 and show them in search engines and on keyhome24's social networks to promote the listing. keyhome24 may also use listing data in anonymous form for market statistics and to improve the site. The site itself (logo, design, texts, software) belongs to keyhome24.
Protection against copying
You authorise keyhome24 to take action, at its own expense and after informing you, against the unauthorised reuse of your listings or photos by other sites (scraping, republication). You keep the right to act yourself.
Prohibited use
It is forbidden to copy or extract listings or contact details automatically (bots, scraping), to use the messaging or contact details obtained for advertising, canvassing or bulk mailing, to bypass checks or payments, to impersonate someone else, and to disrupt the site.
File import
If you publish by import (Excel or CSV file), you are responsible for the content and format of the file and for the links to your photos. An imported listing is subject to the same rules and checks as one entered by hand.
Price and payment
Prices are shown in Swiss francs, including VAT where due, before payment. Payment is by card or TWINT and is processed by Stripe. An invoice is available in your account. A paid listing or request is checked before publication, and its duration starts on publication.
Agency subscriptions
Agencies may benefit from a free trial period and then choose a paid plan. Paid periods do not renew automatically. At the end of the trial or subscription, listings are paused until a new period is paid; they are not deleted.
Credits and offers
Top-placement and bump credits included in an agency subscription, as well as listings or options offered by keyhome24, are personal and valid for the period indicated (for example the subscription period). They cannot be exchanged for money or refunded, and expire when the account is closed. Your remaining credits are shown in your account.
Price changes
keyhome24 may change its prices and plans. New prices apply to later purchases; a listing or period already paid for is not changed.
Refund
The payment covers the publication of the listing or request, or the chosen option, for the stated duration. Once the publication or option has taken place, the amount is not refunded, in particular in case of early withdrawal, sale or rental of the property. If keyhome24 refuses a publication, the payment is refunded in full, except in case of suspected fraud. In case of an error on our part, a double payment or a service not provided, write to us quoting the payment reference. A subscription period that has started is not refunded.
Availability
keyhome24 strives to keep the site available at all times but cannot guarantee it. Interruptions are possible for maintenance, updates or outages. keyhome24 may change the site's features.
Liability
keyhome24 checks listings but does not guarantee their accuracy, the identity or solvency of users, or that a deal will be concluded; the check does not make keyhome24 responsible for the content. To the extent permitted by law, keyhome24 is liable only for damage caused intentionally or by gross negligence, and at most up to the amount you paid keyhome24 in the last 12 months. keyhome24 is not liable for indirect damage (loss of profit, loss of data), for the conduct of other users or third parties, or for interruptions due to force majeure or a provider outage (hosting, network, payment). keyhome24 is not responsible for the content of linked sites.
User indemnity
If a third party makes a claim against keyhome24 because of your listings or use contrary to these terms, you take on that claim and the resulting costs, and provide keyhome24 with the documents useful for its defence.
Suspension and closing the account
You can delete your account at any time in your profile. keyhome24 may suspend or close an account in the event of a breach of these terms, fraud or a well-founded suspicion of abuse; amounts already paid are then not refunded.
Communication
keyhome24 communicates with you by e-mail, at your account address, and through messages in your account. An e-mail is deemed received as soon as it reaches your inbox. Keep your address up to date. You can write to us via the contact form.
Changes to these terms
keyhome24 may change these terms. Important changes are announced on the site or by e-mail at least 30 days before they take effect. The version in force at the time of your payment applies to it.
Transfer and set-off
keyhome24 may transfer the contract to another company, for example in the event of a sale or merger, and will inform you. You may not transfer your account or rights without keyhome24's written consent, nor set off an amount due against a claim against keyhome24.
Severability
If a provision of these terms is void or unenforceable, the others remain valid. It is replaced by the valid rule closest to what was intended.
Applicable law
Swiss law applies. The place of jurisdiction is keyhome24's registered office, subject to mandatory jurisdictions, in particular the consumer's place of residence.
